STANDARD PAYMENT POLICY

All orders of $1,000 or less are required to be advance payment in full. Anything above $1,000 is half in advance with the balance due on completion. So for example...
an order totaling $1,500 will require an advance payment of $1,250 with $250 due on completion. After the initial payment has been made, the order will then be added to the work schedule, and not before that time.

KILL FEE

Once a design order has been placed and entered into the system, it is then subject to a kill fee if the order is then canceled by the customer. This amount can equal up to 50% of the total order cost, but may be less. The exact amount will depend upon varying factors such as expenses and the time which has already been spent on the design project, including such things as phone calls, design reference research, conceptualizing, loss of potential orders from other clients who chose not to place an order due to their potential time slot being already taken, to name a few.
 

DESIGN ALTERATIONS

Alterations are deemed billable if a change is requested to the design that the client did not originally indicate in their order specs/description or order form. It is the client's responsibility to clearly describe any and all design specs which they want to appear within the design. All design instructions including alterations must be in writing either via email or postal mail. Please note that any instructions given/discussed by phone directly or via the answering machine etc. will not be deemed as valid requests. Any design specs or changes, etc. which are discussed by phone or left as a message on the answering machine must instead be sent in writing to Mike Bennett Graphics. Please note that while it is Mike Bennett Graphics goal and purpose to create designs which will meet with the customer's full satisfaction, Mike Bennett Graphics does not make nor imply a guarantee that customer satisfaction will be achieved and the customer understands that in hiring Mike Bennett Graphics to create a design, the customer is paying the agreed upon fee as compensation solely for Mike Bennett Graphics' time and not as a condition of the customers approval of or satisfaction with the design and is therefore obligated to pay all fees agreed to regardless of the outcome. Once an order has been placed, there will be a kill-fee of 50% for order cancellations.

All design work and images used on this website are the exclusive property of Mike Bennett Graphics and are © copyright protected by United States and International Law. All rights reserved. Any use of these designs, layouts, and/or artwork images, without the expressed written consent of Mike Bennett Graphics, is strictly prohibited by law and is also a violation of the seventh commandment against stealing.

LOGOS: Generally speaking, full copyrights are granted to the client for logo design orders with the caveat that the design is used only for the express purpose of being a logo. Any usage of the logo design in its entirety or any parts of the logo design which are used for any purpose other than as a logo as defined in the logo order form shall null and void all copyrights of the client to the logo design and all copyrights are then transferred back to Mike Bennett Graphics.

ILLUSTRATION: Unless specified otherwise in a written agreement between Mike Bennett Graphics and his client(s), Mike Bennett Graphics retains all copyrights to custom illustrations that are commissioned by the client. The client is granted licensed usage of the image(s) as outlined in the written agreement between Mike Bennett Graphics and the client at the time that the order is placed for the illustration.

STOCK PHOTOGRAPHY: Any stock photography that is used and/or supplied by Mike Bennett Graphics in the process of creating custom graphic design work for the client is subject to the copyright rules that are stated by the legal copyright holder of the stock image and the client agrees to abide by any and all copyrights that the owner has stipulated. Once the client has assumed usage and ownership of the design (be it as a website, brochure, advertisement etc.) the client accepts sole responsibility of the rules and responsibilities which the copyright holder has specified, and it is the clients responsibility to find out and learn for themselves what those copyright rules are. The client must obtain proper, legal copyrights to any images that they supply to Mike Bennett Graphics for use in any design work which they have commissioned Mike Bennett Graphics to create and It is the sole responsibility of the client to obtain legal copyrights to any images that are supplied by them to Mike Bennett Graphics for use in any designs which they have commissioned Mike Bennett to create for them. The client also assumes full responsibility for any legal challenges which may arise from the copyright holder (or assumed copyright holder) and holds harmless Mike Bennett Graphics in any and all such legal affairs.
